Independent Prison Adjudication
Prison adjudications can have serious consequences.
While some disciplinary matters are dealt with internally, more serious allegations may be referred for an independent adjudication before a District Judge.

Progression through a prison sentence is rarely automatic.

Judicial Review In Prison Law Cases
Some prison decisions may be open to challenge through Judicial Review.
Judicial Review is not an appeal against a decision simply because someone disagrees with it. Instead, it is a legal process that examines whether a public body has acted lawfully, fairly and within its powers.
In prison law matters, Judicial Review may sometimes arise where a decision appears to be unlawful, procedurally unfair or unreasonable.
Chivers Solicitors can only assist with Judicial Review in certain cases where we have already acted in the underlying prison law matter. For example, we may be able to advise where we represented a client during a Parole Board review and a subsequent decision requires further legal scrutiny. We may also assist following a Category A review that was handled by our team.
In limited circumstances, this may include challenges connected to licence conditions following release directed by the Parole Board. We cannot assist with challenges to licence conditions imposed following automatic release.
Strict time limits apply, and a claim must usually be brought within three months of the decision being challenged.
